Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and zutor.app ("Zutor", "we", "us", "our"), the operator of the Zutor platform available at https://zutor.app. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Zutor is a web-based CRM and scheduling tool for independent tutors. The Service allows users to manage students, schedule lessons, track payments, and send reminders.

3. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account and password.
• You must be at least 18 years old to use the Service.
• One person or legal entity may not maintain more than one free account.

4. Subscriptions and Payments

• The Service offers free and paid subscription plans.
• Paid plans are billed monthly or annually in advance.
• All payments are processed by our payment partner, Paddle. By purchasing a subscription, you also agree to Paddle's terms of service.
• Prices are listed in USD and may be subject to applicable taxes (VAT/GST), which are calculated and collected by Paddle.

5. Free Trial

• We may offer a free trial period for paid plans.
• At the end of the trial, your account will revert to the Free plan unless you subscribe to a paid plan.
• No payment information is required for the free trial.

6. Cancellation and Refunds

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, your paid features remain active until the end of the current billing period.
• After the billing period ends, your account reverts to the Free plan. Your data is retained.
• Refunds are available within 14 days of purchase if you are unsatisfied with the Service. Contact support@zutor.app to request a refund.
• No refunds are provided after 14 days from the date of purchase.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service or its related systems.
• Upload malicious code or interfere with the Service's operation.
• Resell or redistribute the Service without permission.
• Use the Service to store or transmit content that infringes on third-party rights.

8. Data and Content

• You retain ownership of all data you enter into the Service ("Your Data").
• You grant Zutor a limited license to use Your Data solely to provide and improve the Service.
• You may export Your Data at any time using the export features available in the Service.
• We do not sell Your Data to third parties.

9. Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted access.
• We may perform scheduled maintenance with reasonable advance notice.
• We reserve the right to modify, suspend, or discontinue the Service at any time with 30 days notice.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• Zutor shall not be liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands.
